For those businesses concerned with meeting the December 5th deadline for Energy Saving Opportunity Scheme (ESOS) submissions; the Environment Agency have now confirmed that businesses are unlikely to face punitive action on the proviso that they have achieved ESOS compliance by January 29th 2016.
At the same time, the Environment Agency has also been confirmed that only the most serious cases are likely to face civil penalties.
How ESOS Will Affect your Business
If your business has at least 250 staff, a turnover in excess of £42.5 million or a balance sheet over £36.5 million; ESOS requires you to complete an energy audit by an accredited ESOS assessor, which must be signed off by a Director.
Failure to comply could theoretically leave your business facing heavy fines.
Despite approximately 14,000 business being affected by the scheme, only 600 of those had notified the Environment Agency of compliance by November 2015. Given this lethargic response, it is little wonder that the majority of companies will miss the ESOS boat.
However, while the deadline for businesses to complete an ESOS survey and notify the Environment Agency officially remains December 5th , the amendment issued recently now states that companies will “not usually” face fines if they notify the Agency of compliance by January 29th 2016.
